3rd Party Certification

The Department of Labour has decided to appoint third party inspectors for inspection
under following Acts.
|
Factories Acts.
|
Qualification for the Applicant.
|
Note :- Only those possess should apply who person following qualification
|
(1) A person shall not be eligible for appointment as a Third Party inspector unless
he -
|
possesses recognised degree in any branch of engineering or technology and has had
practical experience of working in a factory in a supervisory capacity for a period
of not less than 2 year: or a recognised degree in physics or chemistry and has
had practical experience of working in factory in a supervisory capacity for a period
of not less than 5 year: or a recognised diploma in any branch of engineering or
technology and has had practical experience of working in a factory in a supervisory
capacity for a period of not less than 6 years;
possesses a degree or diploma in the industrial safety
recognised by the State Government in this behalf; and
has adequate knowledge of the language spoken by majority
of the workers in the region in which the factory where he is to be appointed is
situated.

(2) Notwithstanding the provisions contained in clauses (i) and (ii) sub-rule (1),
any person who possesses a rocognised degree or diploma in engineering or technology
and has had experience of less than 5 year in a department of the Central or State
Government which deals with the administration of the Factories Act, 1948 of Indian
Dock Labour Act, 1934; or
Possesses a recognised degree of diploma in engineering of technology and has had
experience of not less the 5 year, (full time) in training education consultancy
of research in the field of accident prevention in industry or in any institution
shall also be eligible for appointment as Third Party inspector

Labour Acts.

Qualification for the Applicant.
|
1. Recognition of third party compliance auditor:-
"Compliance Auditor" would be a qualified practicing Company Secretary who is a member of Institute of Company Secretaries of India constituted under section 3 of the Company Secretaries Act,1980 and approved by the Central Government; and who has not been an employee or on the regular pay
role of the establishment or has not been a consultant of the company for the last three years. The units which submit third party certification regularly on annual basis shall not be inspected through the random
list of inspections. Such units may be inspected only in the event of serious complaints or unrest etc.
2. "Institution" means a firm, association, body, corporate of Company Secretaries, society registered in accordance with the law for the time being in force or an induvidual Company Secretary, auditing the compliance of various laws including labour laws.

I. Inspection under The Equal Remuneration Act, 1976
II. Inspectionunder The Maternity Benefit Act, 1961
III. Inspection under The Minimum Wages Act, 1948
IV. Inspection under The Shops and Establishments Act (as applicable)
V. Inspection under The Labour Welfare Fund Act (as applicable)
VI. Inspection under The Payment of Bonus Act, 1965
VII. Inspection under The Payment of Wages Act, 1936
VIII. Inspection under The Payment of Gratuity Act, 1972
IX. Inspection under The Contract Labour (Regulation and Abolition) Act, 1970
